Terms of Service

1. Scope & Agreement

These Terms of Service ("Terms") govern your use of the TraceGov platform (tracegov.ai, app.tracegov.ai) operated by Quantamix Solutions BV ("we", "us", "Company"). By creating an account or using our services, you agree to these Terms.

If you are using TraceGov on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

TraceGov is an EU-native AI governance platform that helps organizations manage deployer obligations under the EU AI Act and related regulations. The platform provides:

  • TRACE-scored AI-assisted queries for governance questions
  • Governance Library with pre-mapped regulatory controls
  • Knowledge Graph exploration of regulatory frameworks
  • Audit trail with cryptographic verification
  • Document analysis and evidence collection
  • Compliance workflow tools (TRACE Canvas)

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person or organization may not maintain more than one free (Explorer) account

4. Subscription Plans & Billing

4.1 Plans

  • Explorer (Free): 15 TRACE-scored queries per day, 3 workspaces, 5 documents, Web Search, TRACE Graph
  • Professional (€39/month): 200 queries/day, 10 workspaces, 50 documents, Deep Research, Knowledge Graph, Governance Library
  • Business (€99/seat/month): Unlimited queries & workspaces, Audit trail, Canvas compliance nodes, Governance (3 frameworks)
  • Enterprise (€499/month starting): Everything in Business, custom models, SSO/SAML, Canvas API, unlimited assessments, dedicated account manager

4.2 Billing

  • Professional and Business plans are billed monthly in EUR (annual billing available with 17% discount)
  • You may cancel at any time; access continues until the end of the billing period
  • We do not offer refunds for partial months
  • Prices may change with 30 days' notice

5. Acceptable Use

You agree not to:

  • Use TraceGov for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the source code
  • Circumvent usage limits or access controls
  • Share account credentials with unauthorized parties
  • Use automated tools to scrape or bulk-extract content
  • Interfere with the platform's operation or security

6. Intellectual Property

  • Our IP: The TraceGov platform, TRACE protocol, governance library content, and all associated trademarks are owned by Quantamix Solutions BV
  • Your Data: You retain ownership of all data you input into TraceGov. We do not use your data to train AI models
  • License: We grant you a limited, non-exclusive, non-transferable license to use the platform for your internal compliance purposes

7. Data Processing

All data processing is subject to our Privacy Policy. Key commitments:

  • All data processed exclusively in the EU (Frankfurt, eu-central-1)
  • Zero US data transfer
  • GDPR-compliant data handling
  • Data Processing Agreement (DPA) available upon request for Professional and Enterprise plans

8. Disclaimer & Limitation of Liability

TraceGov is a governance support tool, not legal advice.

  • TRACE scores and governance insights are informational and do not constitute legal, compliance, or professional advice
  • You should consult qualified legal professionals for compliance decisions
  • We make no warranty that TraceGov will ensure compliance with any specific regulation
  • Our liability is limited to the amount you paid for the service in the 12 months preceding the claim

9. Service Availability

  • We aim for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance
  • We reserve the right to modify or discontinue features with reasonable notice

10. Termination

  • You may terminate your account at any time via account settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be deleted within 30 days (except where retention is legally required)
  • You may request a data export before termination

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved by the competent courts of Amsterdam, the Netherlands.

12. Changes to These Terms

We may update these Terms with 30 days' notice. Continued use of the platform after the notice period constitutes acceptance of the updated Terms.
